By accessing or using ThinkMoon ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Nature of the Service

ThinkMoon is a software automation tool that provides:

• A technical platform for connecting your own exchange accounts via API keys
• Integration with AI models (LLM providers) that you connect using your own API keys
• Automation capabilities that execute trades based on AI analysis
• Portfolio tracking and performance monitoring tools

3. User Control and Responsibility

You are solely responsible for:

• Your exchange account: You connect and control your own Binance (or other exchange) account
• Your AI provider access: You provide your own API keys for AI services
• Activation and configuration: You decide when to start, stop, or modify automation
• Risk settings: You configure position sizes, leverage, and other parameters
• Monitoring: You are responsible for monitoring your positions and account
• All trading outcomes: You accept full responsibility for profits and losses

You can revoke ThinkMoon's access at any time by removing your API keys.

4. No Financial Advice

ThinkMoon explicitly does not provide:

• Personalized financial advice or recommendations
• Specific asset buy/sell recommendations
• Personalized portfolio recommendations
• Personalized risk management advice
• Any form of investment advisory services

Any AI-generated trading decisions are automated software outputs based on market data analysis, not financial advice. You should consult with a qualified financial advisor before making investment decisions.

5. Risk Disclosure

You acknowledge and agree that:

• You are solely responsible for any trading decisions made using the Service
• AI-generated outputs are not financial advice
• You may lose some or all of your invested capital
• We make no guarantees about profits, returns, or performance

6. No Performance Guarantees

ThinkMoon makes no claims or guarantees regarding:

• Trading profits or returns
• Success rates or win percentages
• AI prediction accuracy
• Strategy performance

Any historical performance data shown is for informational purposes only and does not guarantee future results.

7. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

8. API Keys and Exchange Access

When connecting your exchange accounts:

• You provide API keys that you create and control on your exchange
• You grant ThinkMoon permission to execute trades using those API keys
• API keys are encrypted and stored securely
• We strongly recommend using API keys with trading permissions only (no withdrawal permissions)
• You can revoke access at any time by deleting your API keys

ThinkMoon does not have access to withdraw funds from your exchange account.

9. Prohibited Activities

You agree not to:

• Use the Service for any illegal purposes
• Attempt to manipulate markets or engage in wash trading
• Reverse engineer or attempt to extract source code
• Share your account credentials with others
• Use automated tools to access the Service without permission
• Misrepresent ThinkMoon as providing financial advice or investment services

10. Intellectual Property

The Service, including its original content, features, and functionality, is owned by ThinkMoon and is protected by international copyright, trademark, and other intellectual property laws.

11. Limitation of Liability

To the maximum extent permitted by law, ThinkMoon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or capital
• Loss of data or trading history
• Trading losses resulting from AI-generated outputs
• Service interruptions or downtime
• Unauthorized access to your account
• Any decisions you make based on using the Service

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

13. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. You may also terminate your account at any time by contacting support and removing your API keys.

14. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. We will notify users of significant changes via email or in-app notifications.

15. Regulatory Status

ThinkMoon is a software automation tool and does not provide regulated financial services. The Service does not fall within the scope of investment services regulations because:

• Users connect and control their own exchange accounts
• Users activate and configure automation themselves
• We do not provide personalized financial advice
• We do not manage portfolios or make discretionary investment decisions
• We do not hold or have access to user funds
